January is a time when many people are determined to make life changes and set resolutions, including, it appears, getting divorced. Family lawyers tend to have a spike in divorce enquiries following the stresses of Christmas.
“Christmas may be a happy period for some but for others it can be a minefield of expectations, stress and dispute and this can all erupt over the Christmas period and put a strain on relationships who are already having difficulties.
Thankfully, with the introduction of No-Fault Divorce in April 2022, the law has now changed to absolute no-fault divorce so starting proceedings does not need to be as painful as it used to be in terms of what you both say about the breakdown of the marriage in any application. This makes it easier for everyone involved.” – Suzanne Moore, Family Solicitor.
Since April 2022, separated couples have the option to apply for divorce on the basis that the marriage has irretrievably broken down, although without the need to blame their spouse for the breakdown of the marriage.
Due to these changes to the divorce process, it means many couples can now apply for a divorce on a no-fault basis to keep matters amicable, and we help many come to an arrangement out of court, particularly in relation to financial settlements or arrangements for children.
If Christmas was so stressful then is January too soon to be adding to your stress by beginning divorce proceedings?
“If you are thinking about getting a divorce and Christmas has speeded up that realisation, then it would be helpful to inform yourself about what could happen during divorce proceedings.
Many of our clients have a lot of initial fears and worries which can be dispelled by discussing their situation with us. At Sinclair Law Solicitors we can explain not only the law but how the law will apply to you and what the likely outcomes and scenarios would be.
With this knowledge, you will be able to make an informed and considered decision as to your relationship going forward – whether that is to persevere and repair or help you make a determination that your relationship may be over, and it is time to formalise that ending.” – Lucy Hart, Family Solicitor.

Within 24 hours of popping my details on the website, I had received an initial call. I had a video appointment set up and within a week of my first contact with them, I had the separation agreement over which was exactly what I needed. Really good advice, fair pricing and most importantly great communication.
